1. Who We Are

This website is operated by Expat UK Tax Limited (“we”, “our”, “us”), a company incorporated in Hong Kong (Registration No. 76168440; Trust and Company Service Provider licence TC009817), trading as Expat UK Tax. Our registered office is 23/F, One Taikoo Place, 979 King's Road, Quarry Bay, Hong Kong, and we also operate from Freedom Works, The Mill Building, 31 Chatsworth Road, Worthing BN11 1LY, United Kingdom.

We are the data controller responsible for your personal data. We are committed to protecting and respecting your privacy and, where we process the personal data of individuals in the United Kingdom, we do so in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

As a company incorporated in Hong Kong, we also handle personal data in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486). Our clients are based internationally, and we apply the protections described in this policy to the personal data of all our clients and contacts, wherever they are located, in line with the data protection laws that apply to them.

2. Our ICO Registration

Our UK operations are registered with the Information Commissioner's Office (ICO) under Expat UK Tax (UK) Limited, registration reference ZC069112.

3. What Data We Collect

We collect the following categories of personal data:

  • Contact and identity data: name, email address, telephone number, and postal address
  • Financial and tax data: information you provide about your residency, income, assets, estate, and tax position when you engage our services or use our calculator tools
  • Technical data: IP address, browser type, and pages visited, recorded in standard server logs
  • Marketing preferences: your consent to receive marketing communications

4. How We Use Your Data

We use your personal data to:

  • Respond to your enquiries and provide tax advisory and compliance services
  • Send you information and resources you have requested (such as our IHT guide)
  • Send you newsletter updates where you have given consent
  • Comply with legal and regulatory obligations
  • Improve our website and services

5. Legal Basis for Processing

We process your data on the following legal bases:

  • Contract: where processing is necessary to perform services you have engaged us to provide
  • Consent: where you have given explicit consent, such as for marketing communications
  • Legitimate interests: where we have a legitimate business interest that is not overridden by your rights
  • Legal obligation: where processing is required to comply with the law

6. Data Sharing

We do not sell your personal data. We share it only with service providers who help us run our business and website, and with authorities where we are legally or professionally required to. These include:

  • Microsoft 365 (Microsoft Corporation), which we use for business email and to store correspondence and contact records
  • HubSpot, our customer relationship management (CRM) system, which we use to manage enquiries, contacts, and client relationships. Our HubSpot account is hosted in HubSpot's European data centre in Frankfurt, Germany
  • Resend, which sends the automated emails from our website, such as enquiry acknowledgements, the resources you request, internal notifications, and newsletter updates. These are sent from servers in the European Union (Ireland)
  • Vercel, which hosts this website
  • HMRC and other regulatory or professional bodies, where we are legally or professionally required to share information

We may also share data with our professional advisers and IT service providers where necessary to run our business. All processors are required to handle your data securely and only on our instructions, in accordance with applicable data protection law.

7. International Transfers and Where Your Data Is Stored

We are headquartered in Hong Kong, and your personal data may be processed by our team there, which is outside the United Kingdom. Our main systems store data as follows: our CRM (HubSpot) in the European Union (Germany), and our website emails (Resend) in the European Union (Ireland). Our website hosting (Vercel) and business email (Microsoft 365) are provided by global providers, and we confirm the applicable hosting regions with each provider.

Where we transfer the personal data of UK individuals outside the UK, we take steps to ensure it is afforded a level of protection consistent with UK data protection law, including the use of appropriate safeguards such as the UK International Data Transfer Agreement or standard contractual clauses where required.

8. Data Retention

We retain personal data for as long as necessary for the purposes set out in this policy, or as required by applicable law. Client data relating to tax advice is typically retained for six years after the end of our engagement, in line with HMRC record-keeping requirements. Marketing data is retained until you unsubscribe.

9. Your Rights

Under UK GDPR, you have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request erasure of your data (subject to legal retention requirements)
  • Restrict our processing of your data
  • Data portability, where applicable
  • Object to processing
  • Withdraw consent at any time (where processing is based on consent)
  • Lodge a complaint with the Information Commissioner's Office (ICO)

If you are in Hong Kong, the Personal Data (Privacy) Ordinance gives you the right to access and correct your personal data. You may also raise a concern with the Office of the Privacy Commissioner for Personal Data, Hong Kong (PCPD) at pcpd.org.hk.

10. Cookies

Our website uses only essential cookies that are necessary for the site to function correctly. We do not use analytics, advertising, or other tracking cookies, and we do not share cookie data with third parties for those purposes. You can control or delete cookies through your browser settings.
